1 – Legal Ownership Types

  • Private (Fee Simple) Title – Full ownership, registered in the Public Registry.
  • Fideicomiso (Bank Trust) – Required for foreigners buying within the Restricted Zone (coastal and border areas).
  • Ejido or Communal Land – Special rules apply; extra caution is needed

2 – Understanding Leased Land

Leased land homes can be an affordable option, but you do not own the land—only the structure. Lease terms, renewal rights, and restrictions must be reviewed carefully.

3 – Taxes & Closing Costs

Property Transfer Tax (ISAI) is usually 2%–5% of the transaction value.
Closing costs can range from 4%–8% depending on the property type.

1. Capital Gains Tax Rules

In Baja California, you may qualify for a $200,000 USD exemption per owner if:

You’ve owned the property for at least two years, and
You hold a valid Permanent Residency Card.

Without the exemption, expect up to a 33% capital gains tax on profits.

2. Marketing & Legal Compliance

You must use a legally compliant listing agreement (PROFECO-approved).
Ensure your agent has a valid Mexican real estate license.
